Terms of Use

Who we are

ArchSupply Utilities (the "Service") is operated by Monmaks d.o.o., a company registered in Montenegro ("Monmaks", "we", "us", "our"). By accessing or using the Service you enter into a binding agreement with Monmaks d.o.o. and agree to these Terms of Use ("Terms"). You may contact us at hello@archsupply.com.

Acceptance

By creating an account, subscribing to a paid plan, or otherwise continuing to use the Service, you confirm that you have read, understood and agree to these Terms. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation. If you are using the Service as an individual, you confirm that you are of legal age in your jurisdiction.

The Service

The Service provides a collection of browser-based utilities for architects, engineers, designers and other technical professionals, including unit conversion, PDF signing and PDF flipbook publishing. Available features depend on your plan (Anonymous, Free or Utilities Pro).

Acceptable use

You may use the Service for lawful purposes only. You agree not to: (a) use the Service in violation of any applicable law or regulation; (b) upload, publish or transmit content that is illegal, infringing, defamatory or malicious; (c) attempt to gain unauthorised access to the Service or interfere with its security (including probing, scanning, uploading malware or bypassing technical limits); (d) reverse engineer, scrape or overload the Service; or (e) resell, redistribute or sublicense the Service without our written consent.

Accounts and credentials

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and to keep it up to date. We may suspend or terminate accounts that show signs of fraud, abuse or repeated policy violations.

Intellectual property

The Service, including its software, design, branding and documentation, is owned by Monmaks d.o.o. and protected by applicable intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Service within the plan you have selected. You retain ownership of any files you upload, sign or publish through the Service. You grant us a limited licence to host and process your content solely as needed to provide the Service to you.

Payments and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation and refund mechanics are governed by Paddle's Buyer Terms, available at paddle.com/legal/checkout-buyer-terms. Subscription cancellation and Monmaks' refund handling are described in our Refund and Cancellation Policy.

Service availability

The Service is provided "as is" and "as available". We do not guarantee that the Service will be uninterrupted, error-free or free from security incidents, and we may modify, suspend or discontinue features at any time.

No warranty

To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. Outputs from the Service (including conversions, signatures and flipbooks) are provided for convenience and are not a substitute for professional review.

Limitation of liability

To the maximum extent permitted by law, Monmaks d.o.o. shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data or goodwill, arising from or related to your use of the Service. Our aggregate liability arising out of or in connection with the Service shall not exceed the fees you paid to us for the Service in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be excluded under applicable law (including fraud, death or personal injury caused by negligence).

Suspension and termination

We may suspend or terminate your access to the Service, in whole or in part, if you materially breach these Terms, fail to pay fees when due, present a security or fraud risk, or repeatedly violate our policies. You may stop using the Service and cancel any paid subscription at any time as described in our Refund and Cancellation Policy.

Governing law

These Terms are governed by the laws of Montenegro, without regard to conflict-of-laws principles. Any disputes shall be resolved in the competent courts of Montenegro, without prejudice to any mandatory consumer protection rights available to you in your country of residence.

Changes

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms.
